Welcome to the BARMAH HATS USA Website (“Site”). These terms and conditions are a legal agreement (the “Agreement”) between you and the company or business you work for, and BARMAH HATS USA Corporation (“Barmah Hats”) stating the terms that govern all orders from Barmah Hats and your use of this Site.
Please read this Agreement carefully. These terms apply to all orders, regardless of how the order was placed (whether on the phone, over this Site, or by some other method). You agree that your order of Barmah Hats product constitutes acceptance of the terms and conditions listed below, in this Agreement.
You agree that your use of the Site or any services available on or through the Site constitutes acceptance of the terms and conditions listed, below, in this Agreement. If you work for or represent a business, you represent and agree that you are authorized by that business to enter into this Agreement on behalf of that business. You understand that Barmah Hats is relying on the fact that you are authorized to enter into this Agreement on behalf of that business. If for any reason or no reason you do not agree to be bound by this Agreement, as amended, you must stop using this Site.
Barmah Hats may from time to time amend, supplement or modify the terms of this Agreement. You must check this Agreement periodically for changes. Your continued use of the Site following the posting of changes will also mean that you accept and agree to the changes.
Returns:
Merchandise found to be incorrect due to Barmah Hat’s error would be replaced at no cost if returned within 30 days of receipt of the merchandise. Returns must be authorized by Barmah Hats in advance and you must obtain a Return Authorization number. Cancelled orders or returns of unwanted merchandise (including ordering of wrong sizes, colors, etc.) must be approved in advance and will be subject to a 15% restocking fee plus applicable freight charges. All returns must be prepaid. Please contact Barmah Hats for a return authorization and shipping address.
Export Shipments:
Many Goods that have been imported into the U.S. cannot be exported to other countries. It is your responsibility to check with their freight forwarder to confirm foreign documentation requirements and verify that items to be exported will be released by customs at the final destination. Barmah Hats is not responsible for providing this information or any documentation required to export goods purchased from Barmah Hats or for re-importation to the U.S.
Pricing:
All prices are subject to change without notice. Barmah Hats assumes no responsibility and shall incur no liability whatsoever if price change notices are not received. Merchandise is subject to change or withdrawal, or may be temporarily or permanently out of stock. We assume no liability for delays or failure to deliver due to our inability to obtain supplies. Barmah Hats has no minimum order amount.
Payment:
For online purchases payment is due by credit card or pay pal upon placement of the order.
Ordering/Shipping:
Barmah Hats shall accept your orders in writing, by phone or through electronic means for web-based orders. You may not cancel an order accepted by Barmah Hats, except upon the consent of Barmah Hats in each instance. Barmah Hats shall deliver Goods F.O.B., San Rafael, CA; risk of loss for Goods passes to you once Goods are loaded onto the courier at Barmah Hat’s facility. Barmah Hats shall make commercially reasonable efforts to meet any shipment date stated on the face of any accepted order. However, you understand and agree that shipment of Goods is subject to availability, and Barmah Hats expressly disclaims liablility for any failure to meet such delivery dates. Most orders are shipped via UPS unless otherwise requested. Orders that do not indicate shipping instructions will be shipped at the most economical method to meet the in-hands date as per your order. A drop-shipment charge of $6.00 will be applicable.
Submissions:
You will provide accurate, current, and complete information as may be required in the course of using the Site. You further agree to maintain and update your information to ensure it is at all times accurate, current and complete. Barmah Hats may terminate your use of portions or the entire Site if any information you provide is false, inaccurate or incomplete, as determined by Barmah Hats in its sole discretion. You agree that Barmah Hats may store and use any information you provide on an unrestricted for purposes of lawfully conducting its business, including but not limited to, keeping you up to date on product offerings. Use by Children:
The Site is intended only for those ages 18 and older. If you are under 18, you may not register or submit personally identifiable information on, to or through the Site. Barmah Hats does not collect personally identifiable information from any person Barmah Hats knows to be under 18.
General:
Barmah Hats is not responsible for the use of any product or damage that may occur to any product once it is loaded onto the courier at Barmah Hat’s facility. Furthermore, we are not responsible for verifying the legality or validity of the logos used by our clients. The logo expressed by our clients do not necessarily reflect the view or opinions of Barmah Hats. Barmah Hats, unless specified not to, may use your product on our website, in our catalog or for the use of a third party as a reference or sample product. Barmah Hats reserves all rights to the pictures and images of our products on our website and in our catalog. They may not be printed, duplicated, downloaded or distorted for any commercial usage.
